In a notable move towards environmental protection, the Welsh Government has announced the implementation of key sections of the Environment Act (Air Quality and Soundscapes) 2024. This initiative, marked by the latest commencement order, is scheduled to take effect on 31st July 2025.

The order, known as the Environment Act (Air Quality and Soundscapes) (Wales) 2024 (Commencement No. 2) 2025, is the second of its kind, following a previous order that brought Section 11 into force earlier this year on 31st January.

What Does This Mean for Wales?

This new commencement order will activate several crucial sections of the Act, including:

  • Section 16: Local authorities will conduct reviews of air quality within their jurisdictions.
  • Section 17: Action plans will be required for designated air quality management areas.
  • Section 18: Welsh Ministers will gain directive powers to enforce air quality improvements.
  • Section 19: Regulation of smoke and fuel in designated smoke control areas will be strengthened.
  • Section 20: Guidelines for local authorities on smoke control areas will be issued.
  • Section 21 & Schedule 1: Additional provisions for managing smoke will come into play.

A Step Forward for Environmental Governance

This legislative move underscores the Welsh Government's commitment to enhancing air quality and managing environmental noise. By empowering local authorities and providing them with clear guidelines and regulatory frameworks, Wales is taking actionable steps to address pollution and protect public health.

Huw Irranca-Davies, the Deputy First Minister and Cabinet Secretary for Climate Change and Rural Affairs, underscored the importance of these provisions. He stated, "These measures are crucial for ensuring a healthier environment and improving the quality of life for our communities across Wales."

As the implementation date nears, local authorities and residents alike are encouraged to familiarize themselves with these changes and their implications for environmental policy and community well-being.
